Please read these Terms and Conditions ("Terms") carefully before using the services provided by "The Independent Studio" ("we", "us", "our"). Your access to and use of the service is conditioned on your acceptance of and compliance with these Terms.

1. Description of Service

The Independent Studio provides an online marketplace that connects individuals seeking hair and makeup services ("Dancers") with independent, third-party hair and makeup artists ("Stylists"). We act as an intermediary to facilitate the booking and payment process. We are not an employer of the Stylists, who operate as independent businesses.

2. Bookings, Payments, and Fees

  • Bookings: To secure an appointment, Dancers must complete the booking process on our website and pay the full fee in advance. A booking is not confirmed until payment has been successfully processed.

  • Payments: All payments are processed securely through our third-party payment provider, Stripe.

  • Our Fee: We charge Stylists a commission fee of 30% of the total booking price. In exchange for this fee, we provide a comprehensive service which includes, but is not limited to: securing access to major competitions, booking and managing the official workspace within the venue, processing all client bookings and payments, organising and providing detailed schedules, and handling all customer service inquiries to ensure the smooth running of the event.

3. Cancellation Policy

  • Cancellation by Dancer: Dancers may cancel an appointment up to 24 hours before the first day of the event to receive a full refund. For cancellations made less than 24 hours before the event, we will issue a voucher of the same value, which can be used for a future booking with The Independent Studio.

  • Cancellation by Stylist or Us: If a Stylist cancels or we need to cancel a booking for any reason, the Dancer will receive a full refund and will be issued a voucher for 30% off their next booking as an apology.

4. Responsibilities of Users

  • Dancers: You agree to provide accurate information when booking and to attend your appointment at the scheduled time.

  • Stylists:

    • You operate as an independent business (e.g., sole trader, limited company) and are responsible for your own taxes and business registrations.

    • You warrant that you hold valid and current public liability insurance.

    • You agree to provide the services to a high professional standard and to adhere to the schedule provided by the platform.

5. Payouts to Stylists

  • Following the conclusion of an event, there will be a 7-day window to allow for the resolution of any potential client disputes.

  • After this period, Stylists must submit an invoice to us for their total earnings (70% of all booking fees for completed appointments).

  • We will process the payment to the Stylist's nominated bank account, Wise, Revolut, or other agreed-upon payment solution.

6. Dispute Resolution

  • On-Site Issues: For any issues that arise during an event, Dancers should first seek out our on-site coordinator (if present) or contact us via the provided event phone number for immediate assistance.

  • Post-Event Issues: If a Dancer is unhappy with a service, they should contact us via email within the 7-day dispute window. We will investigate the matter and mediate between the Dancer and the Stylist to find a fair resolution.

7. Limitation of Liability

The Independent Studio's role is to provide a booking platform and facilitate the connection between Dancers and Stylists. While we vet all Stylists for quality and professionalism, the Stylists operate as independent businesses and are solely responsible for the quality, safety, and execution of the services they provide. Any legal claim arising from a service performed by a Stylist is a matter between the Dancer and that Stylist. Our liability is strictly limited to the functions we directly control, such as the booking process and payment facilitation, and in any event, shall not exceed the amount of the commission fee we receive for the specific booking in question.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any changes by posting the new Terms on this site.
